Timing wise, if the Indy Ref results in a Yes vote in October 2014, the hideous Teresa May could not have removed the UKE from ECHR by then.
In the event of a NO vote, though, Scotland would be bound by whatever the Westminster government does in that regard.
I can't imagine many Scots would endorse that, but we'd be hogtied.

Only the Scottish parliament can remove EHCR legislation, they had to vote it into scots law too

OK there are maybe a few guys that slip the net, play the human rights card courtesy of their highly paid legals, but in all honesty BE CAREFUL WHAT YOU VOTE FOR.
To me, the removal of basic human rights and the right to appeal is gonna result in carte blanche for hideous governments like the current UK's to get away with all manner of shite--- in the guise of fighting terrorism.
Sense of proportion required here? Oh I think so.

As mentioned before, numerous times, this country (UK) is lacking a proper written constitution & bill of rights - which contain not only our rights but our responsibilities a well Out of 27 EU countries, the UK is the only one without such a constitution.
But alas westminster governments are shit scared of such a thing as it puts the onus on them to be above board, rather than using that shite about us having an unwritten one which they can bend and flex as they see fit

Very true nota and if one thing in all the history of the UK shows exactly how patronising England is in regard to ordinary people and how they try to show all of the UK and the rest of the world that the UK is how upperclass English people behave and aspire to behave, that is the face that England loves to show the world, as though we are all like that.

Am I not correct in thinking Mr Salmond has promised a constitutions ion if we return to being our own country. Actually I like that, say it out loud, we will return to being our OWN country, not ruled by another nation. No need to go on about independence, just keep telling people we are taking our OWN COUNTRY back from the Tories !!!!
